Legal Question in Family Law in New York

My husband and i file joint taxes. He and I are seperated. I didn't sign the tax papers. I recieved a letter from the IRS that we would be recieving a larger refund than expected. Does that mean he actually filed the taxes without my signature? Can he file without my signature or would he have to forge my signature to file jointly.

I would suggest that you obtain a copy of the original 2009 tax return that was filed and determine what actually happened.

When taxes are filed jointly both parties are supposed to sign.
