Legal Question in Family Law in New York
I've been legally marry to my wife for 8 years with 2 kids. She packed somethings & went to live with her mother with the kids. She is been going partying but still comes home and have sex with me. The other day the cops showed up with a restriction order against me. They told me I can't go near her or my kids. Her family bring texting me to drop off the kids with her approval. I was also served with custody paper for March 2012. How can I see my kids now without ending up in jail since the cops told me I can't get near them? I want a divorce but don't want to pay alimony since she abandoned the house and is known to be dating? How can I get myself & kids out of this mess- I want full custody since she has never work her entire life and sees a shrink?
