Legal Question in Family Law in New York

I have been legally seperated from my husband for almost two years and we filed for divorce three months ago. I am pregnant by my live-in boyfriend and I would like to know if I can give the baby my boyfriend's last name and list him as the baby's father.

Your boyfriend can sign the child's birth certificate and acknowledge paternity when the child is born.
