Legal Question in Family Law in New York

If my wife is currently paying a mortgage and we want divorce and my under age kids live in that house does she have to sell the house or buy me out?

The court may not order her to sell the house immediately, if at all. There is also the issue of who owns the home, when was the house purchased (before or during the marriage), and the age of the children. If there are children and assets involved, you should seriously consider taking the time and spending the money for an initial consultation with a local experienced attorney.
