Legal Question in Civil Litigation in New York

''other woman'' is a nightmare

My husband had an affair, the other woman blackmailed him for several thousand dollars. He then had the opportunity to get the money back from her. She is now saying it was a loan. He did not sign anything, except the Western Union receipt; she is now suing him in small claims court for $5000 & $1500. She does have a voicemail of him asking for the money. We have voicemails of her saying she wanted to repay it. Are these admissable and what are our chances of losing/winning? PS: this is just the tip of the iceberg with this situation, we've had a protective order and had her arrested for stalking, we moved to another state to get away from her. Help!

You have a great chance of winning and you can use the tapes (as can she.) You should also be able to bring up the criminal issue and the POP. You should seak to a lawyer as well to see if there is anything else you can do.

Good Luck.
