Felons legal status after DWI

what is a NY person right to keep permanent residency after a dwi conviction/felony in Nassau & 5 yr probation with no jail time? chances of renewing alien card & staying in the USA

This all depends whether the alien has already have a green card or just applying for on; whether he completed 5 years probation and the exact charges and pleas he entered.

When you renew your green card, you have to be fingerprinted and USICS will find out about your conviction. Instead of renewed green card, you might get into the removal proceedings before an immigration judge. Chances to win the green card back are case and facts sensitive and might differ. An attorney has to know more facts in order to answer your question. You might be eligible for cancellation of removal for certain lawful permanent residents. Be aware that travel outside of the U.S. and return might trigger the removal proceedings and sometimes mandatory detention.
