Legal Question in Immigration Law in New York

Hi,

I have won the green card on the DV lottery and I am permanent resident of the United States since September 2011. I have spent only two weeks in the US in September and I travelled back to Tunisia. I am physically in Tunisia now and I am planning to relocate to the US in the near future.

I found out recently that the date of birth is wrong on my green card. This is a USCIS error.

I know that I need to file I-90 but I have some concerns:

- Can I file I-90 while I am in Tunisia?

- Will I need to go to a biometric appointment?

- If I file I-90 while I am in Tunisia, can I still enter the US with my passport? (I have a stamped immigration visa that is supposed to play the role of a green card for one year and that expires in September 2012)

Hello:

While this can be done, you need to make certain you are not outside the U.S. more than 6 months at a time so you don't lose the opportunity to apply for citizenship.
