Legal Question in Employment Law in New York

slip and fall

my friend fell at work because the employer mopped the floor while he was working. He was taken away by ambulance. He broke his pelvis and required surgery with metal plates and screws to repair it and will be unable to walk or work (he has to stand to work) for at least 6 months (he will be in rehab). Does he have any legal options or is this just a work. comp case? He was told he couldn't sue because it was a work comp case. Is this accurate?

Re: slip and fall

If your friend was injured on the job and you cannot show that there was a third party (non-employer related) who was responsible for the slippery condition, then this sounds like a workers' comp case. You need to inquire as to who was responsible for maintaining and mopping the floor (was it an outside maintenance or cleaning company). I would be happy to discuss this further with you or your friend. Feel free to contact me with any further questions.

I would need to discuss the facts with the injured party ASAP to review all options.
