if i need surgury and will be out 5 months and have 6 months sick time accumulated can they fire me after 12 weeks under the family leave act

You can hold them to your employment contract.

I am assuming the sick leave is set forth in an employee's manual or other written document.

It may be necessary to file a wage claim in your local court.
