Legal Question in Employment Law in New York

unfair dismissal

I was fired for refusing to take a drug test, I did not refuse, I stated that I would discuss the drug test when a large sum of money ($805.00) was returned. My employer fired me and told the unemployment office I was fired for refusing the test.I have scheduled an unemployment hearing. Its been over 3 months since being fired and I am losing many job opportunities. What should I do

Re: unfair dismissal

what do you mean you are losing job opportunities? If you are not accepting offers you won't get unemployment. As to the refusal, if it was a legitimate request, you must do it when they specify, not at a time of your choosing.
