Legal Question in Employment Law in New York

unjust failure to pay wages

article 6 provides for the attorney general to help collect unpaid wages. it is a misdeameanor to withold wages. Unfortunately protection/help is for employees earning $600.00 per week or less. How does someone who earns $2,000.00 per week collect their money without having to retain an attorney and have to spend money to collect what is rightfully theirs. I have three kids and 2000 per week barely makes ends meet. giving up 1/3 or paying hourly could cost alot of money which i need. my employer owes me over 17,000.00 for professional services already rendered but she doesn't want to pay since i left her employ. i gave the appropriate notice but she won't give me my money. she just says...so sue. what labor laws protect and help me?

Re: unjust failure to pay wages

Depending upon the facts of your case, the Department of Labor provides a statute by which you are eligible to sue for lost wages. More importantly, depending upon your circumstances, you may be eligible for attorneys' fees if you decide to sue for your lost wages and you are victorious. Thus, you can engage an employment attorney who knows the law AND recoup your lost wages and any fees you paid out if your lawsuit is successful.
