I think that the remaining person would be responsible for their rent. You may want to think about whether you want the remaining tenant to stay or to rent the place to someone else. It is unlikely the remaining tenant could afford the rent that you are asking. First decide what you want to do then consult with a competent landlord tenant lawyer in your County. If you need to find a landlord tenant lawyer call you local bar association.
