Home ownership after a death?

My mother passed away, her home is in the name of my father and her. She did not have a will, I am wondering if there is anyway we can go to court and have her 1/2 of the

house given to myself my half brother and half sister.

Very difficult to do. You would have to demonstrate that the transfer of the house from mother to mother and father was based on fraud, or that the mother did not have the cognitive ability to transfer the house.
