Legal Question in Product Liability in New York

foreign object in food from manufacturer

about 2 weeks ago I purchased a well known yogurt , after eating half of it I spit out a bandaid, I obviously became sick to my stomach, I went to the doctor next day and was told I could not get sick from it, I am going back in 2 days because I cannot sleep,eat and become nausiated when I think about it, I also now put most food in a collinder to make sure theres nothing there, They want the product for testing, but I refuse to give it to them until settled, they may ''lose the evidence'', a lawyer I talked to(did not yet retain) said maybe a few thousand for compensation, I am trying to work with the company myself and I think they want to know what I have in mind, for the emotional distress this has caused and the fact the bandaid was even in there, I am thinking more like 20,000, is that reasonable? or will i be laughed at?

I received your post on 6-28-2001.

The answer is $20,000.00 is very high. I haverepresented CPC (Muellers, Arnolds, Stella Doro etc) in similar matters. After the proof and some depositions, the matter settled for what amounted to be "nuisance value", where the only injuries where "psychic".
