neighbors tree falls down onto my property

Is my neighbor responsible for clearing his fallen tree out of my yard?

Not unless they were decayed/dead AND your neighbor knew or shouldv'e known they were decayed/dead.

Doesn't seem fair I know.

No. But, you MAY be able to charge (and sue)your neighbor, for the cost of removing the tree, from your yard.

Take pictures, get an estimate and TALK to your neighbor.

Suggest that you PLAN to settle this matter amicably, with your neighbor; or with your insurance company, unless you are planning to move.
