Legal Question in Real Estate Law in New York

Remove his name from contract

My boyfriend and I recently purchased a doublewide with a private contract (in both our names) directly from the owner (they are holding the mortgage). My boyfriend is a compulsive liar and cannot hold a job to pay his share and I want him out. How do I get his name off of the agreement so it is in just my name.

Ask the note holder and your boyfriend of they will re-work the names on the agreement and note and mortgage.

Have him transfer his interest to you. Let the note holder acknowledge that you are the sole owner. If there was any registration or other recorded documentation, it must be re-registered so only your name appears.

You have to have your boyfriend transfer his interest to you and then record the transfer and new note. If you and your boyfriend purchased together, you may want to offer to pay him his half for the transfer.
