Legal Question in Real Estate Law in New York

withholding maintenance

I am a shareholder in an coop with a corrupt board and manager (pres and manager are the same for 20 plus years). If I am not getting information that I am entitled to by way of a coop board/manager (the manager my maintenance is paying for) could I be able to put my monthly maintenance in a legal escrow account, thereby forcing them to deal with their negligence and leaving a paper trail in the meantime?

Re: withholding maintenance

It depends on the terms of your proprietary lease, which I am all but certain does not permit you to unilaterally withhold maintenance, for any reason. Consult an attorney to determine whether the board or management is breaching a duty and, if so, whether you have any viable options to remedy same.
