Legal Question in Workers Comp in New York
have not been paid
i have a good friend who worked off the books for someone the woman owes her close to 2k and is giving her a hard time . can she sue her in small claims and since it was off the books will she myfriend get in trouble.i feel its unfair but was a travel agent before i lost my job so i am not a lawyer and want her to do the right thing

She can sue in small claims. The small claims court will not make any report to the IRS.
The lack of documentation may crreate a proof problem, but not a criminal or tax problem.
