Legal Question in Real Estate Law in North Carolina

I have just ended a 12 year relationship (live in North Carolina). We were not married but we bought a home together. I had to leave the home and most of my personal belongings behind when I left. I have requested my belongings be returned many times and the other party has refused. I would also like to either force the sale of the home or to be bought out of my half. What are my legal options to settle these two matters.

I don't know what to tell you about the belongings. If she doesn't give it to you voluntarily, can you go there and take them? If you own 1/2 the property, you are entitled to be there. I am not a criminal lawyer but you may be able to go to the police and prove that you own the property and have them accompany you there so there is no trouble.

Regarding the real estate - if you own half the property, you are entitled to bring a partition action to have the property sold. Practically, you need to work this out with the other party because it will not be cost effective to bring this type of action. In fact, you do have the right to live there as a co-owner unless there are other matters involved like restraining orders.

If you cannot come to an agreement with the other person, I would consult with a real estate attorney in your area and maybe have a letter written asking to be bought out or to agree to sell the house.
