Legal Question in Criminal Law in North Dakota

attorney gets new info helping client but does nothing

i have a neighbor who just recently informed me that she was arrested for possession of meth and now is looking at 2 years in prison come tuesday january 3., at her sentencing. what happened was , this friend of mine was helping me add an addition to my shed until i found a box that belonged to him with meth paraphernalia. i told him i didnt appreciate him hiding that here and i changed the lock.

apparently, this neighbor had asked him to do some work for her. in a nutshell, the box the cops under this ladies bed was my friends. when i confronted him about it , he just shrugged his shoulders.

Now, since i know whose box it was , i called her attorney and explained that box { which she denies any knowledge of } , was in fact , not hers. he hasn't returned my calls and when this lady friend asked to if it was possible to lift prints off the box, he simply replied'' so you want to play that ,huh''?

this lady is going to go to prison for 2 years , for something that not only is she innocent of , but had no knowledge of , and her attorney since this is his ''turn' to do pro bono work, is going to let it happen , knowing that there is a witness who can testify to who's box that belonged to. help me , help her, please.

You seem to be carrying the cudgels for your lady friend. If she is indeed innocent, she would take the lead to exculpate herself. Under the laws on evidence, "every person is expected to take care of his concerns." For further queries, you may reach me at [email protected].
