Legal Question in Business Law in Ohio

Consumer Fraud

Bought an expensive pair of boots- never worn. Took to shoe repair shop to have fitted to my calf. Paid $60 for the service. TWO years later- still no boots repaired AND they dyed them (without my permission). Present owner of shop said he bought the shop from his cousin, who is now back in the Ukraine, although he was in the shop when I 1st brought in the boots. I have been back to the shop approx. 8 times, and each time he has a different excuse as to why the work is not done. He says he is only going to finish them as a courtesy, he has no obligation to fix. Says it's his cousin's fault, not his. I am frustrated and angry at how he conducts his business, and at a loss as to how to proceed. Want the boots fixed AND my money back due to delays/time spent driving there, and ruined boots due to dye job. Please advise as to next steps. Sue in small claims under fraudulent business practices? Thank you.

Re: Consumer Fraud

First of all, have you tried Gino's at Kamm's Corner on Lorain?

Secondly, getting your money back for the delay is not possible. Getting it fixed is. If you want to take them back and then to someone else, you can sue them, but it's hard to say whether this operation is collectible. You might want to stick with them until they are fixed.
