Small claims on personal loan

4 years ago a fiance gave me a check for 3,000. for personal use with no reason to give it back but we broke off the engagement so hes mad at me and suing me in small claims for it back saying it was a loan , but it wasnt , now its going to trial because we could agree in the first hearing , what can i do , he has the cancled ckeck but thats it , its his word against mine. thank you

The burden of proof is on him to establish the debt. If there is no indication of the loan on the check, you should do alright.
