Legal Question in DUI Law in Ohio

prior record affect dui

I have a couple drug felonies from '04 and '03 (non driving related) I just got a dui 9/07. Will my prior record have any affect on my dui sentance?

Re: prior record affect dui

If you are convicted on the OVI the judge is permitted to look at your prior record before sentencing. Your prior record suggests a history of substance abuse, and an OVI is another example of how substance abuse (alcohol, in this case) caused a problem with the law.

There is not hard and fast answer, but if I were betting on it I would bet that the prior offenses will cause the judge to be more strict than he or she might be on a true "first offender."

Good luck with your case.
