Legal Question in Family Law in Ohio

What all do I need to take to my child custody case? I left my husband 3 years ago we are not yet divorced and there is no standing custody order but for the past 3 years I have been the sole provider for our son he hadn't even seen him during the whole time by his own choice. I presently let him spend a weekend with a verbal agreement for him to have him home on Sunday at 6 pm to be ready for school the following morning. He decided he wasn't going to bring him home because I asked for help with groceries. He filed for child custody saying I have no food in my house and that I'm a threat to his son. What can I do to get my son back home?
