Daughter's name change

My daughter currently has her mother's maiden name. Paternity papers were filed at birth, but there was an error at the state offices. We are divorced and agree the name needs to be changed. We do not reside in the state of her birth. Does this need to be handled in her birth state or the current state of residence?

If you want to correct her birth record it has to be done at the place that keeps her birth record on file, usually the vital statistics office of the person's city hall.
