Legal Question in Family Law in Ohio

divorce

is it better to divorce my spouse now (he's very ill, dying from alcohol related disease) to get out from under the debt he's caused, or should I try to handle the debt and ''wait it out''? It sounds awful, but I've tried to help him for 3 years now - we are separated and I have our 2 children.

It depends. If the debt is marital debt, you may be responsible for half of it in the divorce decree anyhow. If it was solely created by him either during the marriage or after you separated, it may not be your responsibility. If you divorce him, you will give up all your rights to any inheritance that he may have. It is hard to give you any real advice without knowing assets and debt amounts. This includes any inheritance you may be entitled. I would definetly contact an attorney to discuss this in great detail.
