Legal Question in Family Law in Ohio

My nephew's wife moved out of their house on September 12, 2009. She took everything in the house including paperwork that included tax returns. They are in the process of custody and divorce hearings. My nephew's wife has not worked for over a year and I don't believe they filed jointly. Is it against the law for her to keep those tax records if they are not listed as a joint filing. He would probably need those back to file his 2010 taxes.

He can easily request a certified tax transcript from IRS by calling their 800 number.
