Property Question

A year ago I purchased a home. In the purchase contract the seller had 30 days to remove all personal property. At the closing 3/15/2006 the previous owner stated that there were about 15 sandstones on the property and that she wanted them but may not be able to move them within the 30 days it might take another month. We told her no problem. 13 Months later there was not communication to us and the stones were not removed. We assumed that after a year with no communicaiton she did not want them and we paid a contractor to come to our property and landscape our lot with them. The previous owner contacted me this week and said she heard we moved the sandstone and she wants them now. I told her it was too late and we have paid to have them moved on our own property. Does she have a right to them or do we?

The former owner initially had 30 days to remove all of her personal property. You were kind enough to allow her additional time due to the weight and size of the sandstones. In the question you stated she said it might take another month, which you said was not a problem. You in fact waited 13 months, and she did not come to remove the stones nor contact you about them. The stones are now your property.

If the former owner wants them bad enough to sue, invite her to sue you and then call an attorney.
