Legal Question in Insurance Law in Ohio

Accident in 99 took over 3 yrs to suspend license

I had an accident on 11/2/99 Which I am just now finding out I was found at fault. The accident was in Ohio but the insurance company suing me is based in Indiana. I have been able to use my license for the past 3 years until suddenly I find that I have a judgement against me from the insurancce company stating that I had an auto accident in Indiana and I was found at fault with no insurance. My question is, how is it that I am being taken to court in a state that my accident was not in? Should they not have to come file in the state that the accident occurred? I check my police report regularly and I have a recent one that states I have no trafic or otherwise on my record in the county which the accident happened. How can they take me to court three years later for an accident they never reported me liable for til now? And on top of that why do I have to go to court in another state for a judgement that happened in Ohio? The person whose car is in question also resides in Ohio.

The question of interstate jurisdiction is a complicated one, and more information would be necessary before giving you any legal guidance. To begin with, a copy of any judgment should be reviewed, as well as any correspondence you have received from the insurance company attempting to collect from you. The question of suspension of driving privileges is a separate issue, as you can be suspended in Ohio if you do not have insurance.

Please consult with a local attorney to review the documents.

Good luck,
