Fmla and workers comp

I was injured at work in august and have been on workers comp. Last week my employer notified me(by phone) that i had been put on FMLA leave and my twelve weeks were up and i would have to start paying full price for my health insurance effective Feb. 1. Dont they have to notify me in writing when they put me on FMLA? I was told that FMLA can only start at time of notification. PLEASE HELP

The injured worker is goverened by workers comp law.

For the employer to do what you state you would have to reach MMI or otherwise have been released by your doctor to return to work. I would file a an action with the court asking for an opinion of crossover rights between state and federal.
