Legal Question in Personal Injury in Ohio

I was assulted at a party and I didn't fight back

I was punched twice at a party where there was drinking involved. It caused my tooth to puncture through my lip resulting in a total of seven stitches (four outside and three on my inner lip). I did not throw any punches back or any kind of retaliation. I am considering pressing charges against the individual, who is 18 years of age. I am wondering what kind of punitive damages I could ask for and also what the maxium punishment he could get if i decide to press charges.

Re: I was assulted at a party and I didn't fight back

You can have the person charged with assault which is a misemeanor of the first degree max penalty is 6 months in jail and/or $1000 fine. You can sue the person who assaulted you, but you need to see if he is at all solvent. In other words, if you sue him and collect a judgment will you be able to collect from him. It would be my suggestion to try the Victim of Crime fund act in order to get your bills paid. As far as punitive, use the criminal justice system.
