Is my dad liable for a fall??

Hello,

My question is this. My father owns--name removed--rental property and he was paying someone cash ( under the table) to to some repairs on the home. I should state that he owns--name removed--roofing company and pulled the permit in the company name. Well the guy was doing some roofing repairs for him and fell puncturing his spleen. He died several hours later in the ER. The workers family is trying to sue for his death.My fathers business insurance told him they are not responsible, since he was not on--name removed--company job or payroll.His homeowners insurance has reviewed the scene and the stories and are not giving him any info.I think he would be okay since the worker was being paid to work, but should he worry about--name removed--large lawsuit??

First, what about workers comp. His estate can file a claim. Second was the worker an employee or an independent contractor. If an independent contractor, then the worker provides his own coverage, if an employee, then the boss provides coverage.
