Legal Question in Personal Injury in Ohio

MRSA infection and colonization.

I contracted a mrsa infection at work. I was put in the hospital. I am now colonized,I will have it the rest of my life. I asked my employer at least 5 times about boils that were on a resident. I asked her to get a culture she refused.

Can I sue? My employer denied my w/c and at the hearing officer discovered that she had falisfied medical progess notes to look as if I was infected before the residents.

There may be two different claims you can make. The first would be a VSSR (violation specific safety rule) claim through workers comp. The next is an intentional tort case. These are very difficult and often there is no ins. coverage to the employer. Each should be investigated and you should contact a qualified attorney in your area to look into these claims.
