What parties will be held responsible for a fatal overweight truck accident?

If an overweight dump truck leaves a mine and hits a passenger vehicle killing one of the occupants, who can be held responsible in civil and criminal court? The criminal finding in this case was never solved because of there was no conclusive evidence of who ran the traffic light. However, the case went to civil court and I am concerned that the outcome may involve the scalemaster, loader operator, and owner of the mine because they all had knowledge that the truck was overloaded when it left the premises.

The owner / company can be held liable if it is found that the violations helped cause the accident.

The driver is definitely on the hook as well.
