Legal Question in Real Estate Law in Ohio

private property encroachment

my question concerns private property encroachment.

I recently found out that a commerical building was built about 15 feet onto my property. This building and parking lot was built about 25 years ago.

What legal recourse of options are there for me to address this new discovery? The property is located in Geauga Co., in Ohio.

I'am not sure what to do next.

You have a couple of options. You can confront the owner of the building that is trespassing and work out a "sale " or an easement. The other option is to contact the title insurance company and/or the firm that did the survey when you purchased the house and get damages. The problem is that since it has been there for 25 years, they may have a "prescrptive" easement.
