arrested for possession of marijuana

I was arrested for possession of marijauna and drug paraphanelia and was told at the time they were misdemeanor charges. My court date is about a month away ,do i need an attorney ? What are the penalties for such charges ? I have no priors , What happens next ? Thank You in advance.

A misdomeanor possession of marijuana carries up to one year in county jail, the same applies to the paraphernalia charge. Combined, you COULD do up to one year in jail. However, the fact that you have no priors weighs heavily in your favor.

Your next step depends on where you are in the process. You definetly need an attorney to protect your interests. This is especially true if you plead guilty to the charges, thus ensuring you get the best possible deal from the District Attorney (many DA's won't even speak to an unrepresented defendant). A deferred or suspended sentence is definetly possible in your situation. This could mean the difference in spending time in jail or simply receiving probation.
