can i be evicted

i need to file bankruptcy because i lost my job. i am up to date on my apartment rent and intend on staying that way. can i be evicted just for filing chapter 7.

A landlord is only sent notice of the bankruptcy if you owe money to him. If you are up to date on the rent, you shouldn't worry about being evicted. I offer free consultations.

No, you can opt to keep the lease. The bankruptcy trustee will review your bankruptcy schedules to make sure you have sufficient current information to avoid getting in debt again, so being employed when you file is a good thing.

Most of the provisions of the new bankruptcy law do not take effect until 180 days after the law was signed, which was on 04/20/2005.

No you cannot. As long as you remain current on your lease, you will be permitted to retain your apartment.
