Assuming that a paternity test proved that your son was the biological father, he is entitled to shared custody of his daughter, but he cannot assert his rights without first having the Court enter a Custody Order which would define his rights as well as the rights of the mother of the child.

Your son should file a "Complaint for Custody" and have the Court enter an Order setting forth the custody rights of both the mother and the father. Once the Custody Order is entered by the Court, if either party fails to comply with the Custody Order, the aggrieved party would have the right to file a Petition for Contempt, asking the Court to hold the other party in Contempt of Court and imposing appropriate sanctions on the violating party.
