Legal Question in Consumer Law in Pennsylvania

I called plumming co. to get estimate to repair broken toilet pipe. He gave 300 to 400 dollars estimate over the phone. But after the work done, he send me a 1010 dollars bill. I paid just portion of the bill, estimate portion,adn refuse to pay the rest, He send me letter, he demand respt of the payment. Or he will pursue this matter with lacal magistrate. Can he sue me with out contract and overestimate bill...thanks...jimmy

He can sue you, but unless he has something in writing where you agreed to pay the higher amount, you have pretty good defense. You should consult with a local lawyer, who should only charge you a relatively small amount to go to court with you (not more than $200 and maybe less) or you can go to court yourself. Without anything in writing, its your word vs. his. No reputable plumber would do a job over $1,000 without getting you to sign an agreemnt or estimate.
