Re: minors and car sales

You asked about a car sale between minors.

In most cases a minor cannot be held to a contract and the contract can be rescinded. This is a means to prevent adults from taking advantage of minors.

In this case since both sides of the transaction were minors, and the purchasor has potentially harmed the value of the property a judge would be unlikely to order the transaction unwound.

The clear law is that the sale of personal property between individual parties is as is unless otherwise agreed in writing. In almost no case will a court determine that a seller needs to pay for repairs to a vehicle after the sale has taken place. The time for prudence on the part of a purchasor is before agreeing to the transaction.

No guarantees but in this case the purchasor has few options. You do not _have_ to unwind the transaction. But the other party may take you to court.

Roger
