Legal Question in Credit and Debt Law in Pennsylvania

chech cashing

My fiance receives his payroll checks in the form of a personal check from his boss' check account. once, his boss had no money in his account and the check bounced. now, since the check was written out to my fiancee and he is the one who cashed the check, the check cashing store is taking my fiancee to court to pay the amount of the check plus some service fees. are they allowed to do this, or shouldnt they go after the person who wrote the check and the owner of the checking account which was overdrawn?

Re: chech cashing

They gave himthe money, so they may choose to go after him alone. If that's the case, then your fiance cross-claims against his boss. Why hasn't his boss just made good on the check? Best case, the check cashing place gets a judgment against the boss, and not your fiance, if the fiance has done nothing wrong.
