debt collection harrassment

I joined a gym for my children to use. They were supposed to take the payment from checking account. The first payment was to be taken on 7-10-02. Did not attempt to take it until 7-27. The made no other attempts to take payment. I no longer used gym because of this error. Now they put it into collections and the firm called me and demanded payment in full within 24 hours or I would be sued in court and then sheriff sold. I asked if I could make it in three payments of $200 each. He replied no. After 30 min he called back stating that they would accept $322 within 2 hours. I was unable to gather that much money in that short of time. He called me back this morning and said they would send in the sheriff. What are my rights. I did not refuse to pay just to make payments as I am currently unemployed. Thank you for any help.

They do not have to accpet a payment plan. It is best to negotiate a payemnt plan with them that you can afford. Their remedy to sue you and get a judgment, then execute on the judgment.
