Legal Question in Credit and Debt Law in Pennsylvania

I have been fighting with a company called Fingerhut since August 2012. I recieved a bill from them but I've never had an account there. The only information on the account that was mine was my name and social. I told them I never opened the account but they told me its not their job to check the information because the name an social matched. The bill keeps going up and now their threatining to sue. What are my rights? I never bought anything from them

Did it ever cross your mind that either (a) someone close to you created an account in your name OR (b) someone really screwed up and this is an account for someone that has the same name as you? Do you have an uncommon or common name? If you have an uncommon or unusual name, then you may be the victim of identity fraud.

If you are the victim of identity fraud, you need to follow the steps outlined at www.privacyrights.org - fact sheets 17 and 17 a. Have you ever pulled your credit to see if there are other strange accounts? Or is this the only one?

Regardless, stop talking to these idiots. Phone calls don't happen. All of your contact going forward has to be in writing. You ask "what are your rights?" Its not possible to answer without knowing more facts. Is this with a debt collector? Or still with Fingerhut? Is the debt on your credit report? Have you taken steps to dispute in writing by sending a certified letter?
