Legal Question in DUI Law in Pennsylvania

PA DUI Suspended License

I have 3 DUI's, and my license was suspend by the courts for 18 mos., but 5 years from PENNDOT. It has been 3 years... I got pulled over for speeding, non-DUI related...Will I face the 60-90 days in prison?

You are looking at 60-90 days for violating 75 Pa.C.S. Sec. 1543 (b) 1.1 . You need to speak to a lawyer about your possible defenses and sentencing options. I offer free initial consultations.

Re: PA DUI Suspended License

You will face a mandatory minimum of 60 days in jail. It is important to try to get this citation amended at the District Justice level. If not, you can file an appeal in the Court of Common Pleas. Often times it is more difficult to get something worked out at the higher level when the DA's office gets involved.

Re: PA DUI Suspended License

Why was it suspended for 5 years?

If it is still listed as a DUI related suspension, then you will get the mandatory 60-90 days.
