getting divorce without other parties consent.

If your spouse does not agree to a divorce, how long do you have to wait before it automatically becomes final- do you have to wait 2 years from the date of filing, 2 years from the date the origional 90 day waiting period ends, or 2 years from the date you seperated?

Re: getting divorce without other parties consent.

If you have been separated for a two year period, a spouse can obtain a non consentual divorce in Pennsylvania. However, all issues of equitable distribution of property could remain, if the other spouse demands a hearing. If I can be of any assistence please let me know. Gerald Hershenson 215-579-9390
