Legal Question in Family Law in Pennsylvania

Divorce Question regarding property

My wife and I have been separated for about 3 months now. We bought a house 6 months after we were married. Due to past credit problems, the mortgage was put in her name. If she files for divorce, do I have any legal claims to the house if I choose that I want it? Can she sell it without me knowing? I was present at the settlement on the house, and there were some papers that required my signature, but the mortgage bills have her name on them.

Re: Divorce Question regarding property

There are several issues here. Property acquired during the marriage may be subject to an equitable distribution. If you are not on the mortgage you may be on the deed. If you are on the deed she cannot sell it without your permission. Find that out before you go any further.
