Can he kick me out?

My husband is trying to kick me out of my apartment. He told me that he would call the police and tell them that I hit him so they remove me. How can I protect myself? I do have a house in Florida, can I take my child and move back to my house (it is my Primary residence we're up here in PA Temporarily) without any reprecusions?

You asked about relocating with a child.

You really need to speak with an attorney directly about this matter. As a general rule, if there is no custody order then either parent may relocate with a child wherever they wish within the country.

Depending on your particular circumstances it may take as long as six months for the new state to be considered the permanent residence of the child so that the custody petition could be filed there. Again, an attorney directly and completely informed as to the matter will be able to advise you properly and you should not act until you have been so advised.
