Legal Question in Civil Litigation in Pennsylvania

defamation

My girlfriend's soon to be ex-husband wants to make statements to police officers, people at a hospital and pretty much everywhere that I abuse the kids. I never have, never had police ask me about such abuse or anything and want to know if there is any legal recourse in PA to get him to stop slandering and defaming my name. I am an Insurance Agent in New York State but live with my girlfriend and her children in Pennsylvania.

The answer is, yes. You can file a defamation action against him in Small Claims or the State Trial Court (Common Pleas in PA and NY Supreme in NY). In reality though, you probably do NOT want to pay an attorney an hourly rate to litigate the matter. I have handled these cases by entering into a fee agreement to handle the matter short of filing a formal complaint. By using a cease & desist demand and a demand letter for settlement, negotiation, and a release agreement agreeing to no longer make such statements, you can get a defendant to agree to stop defaming you.
