Ebay dispute

I recently ''sold'' an item on ebay. The winner bidder has not paid. He lives an hour away. Can I file a suit in small claims court in my home co? or should I go to his? -Do I have a case? Note: Ebay user agreement states ''that this is a legally binding contract''
