our son is 20 and a drug addict we want him out of our home

He doesn't have a lease. He doesn't have any other right to stay there. You have to give him reasonable notice. (Reasonable notice will vary according to locality.) You can make certain conditions applicable for the remainder of his stay, such as no drug use, and so on.
